Every day, we witnesses many labourers herded in pick-ups and lorries being transported to construction sites. The problems this overloading creates are mind-boggling and the various legal ramifications need to be examined.

Lorries are not meant to ferry human beings. The drivers and owners of the lorries commit various offences under the Traffic Act.

They range from dangerous driving, using a vehicle as PSV without a license, overloading and dangerous driving. Why the protection by police?

 

The police are failing in their statutory duty to enforce law, which itself is an offence under the Police Act.
The Commissioner of Police is exposing himself to prosecution. In case of an accident, a claim for damages can even be stretched against the Government.
